In what appears on the surface to be sideshow antics by the lawyer in the Bali bombers case, he has now retracted the appeal because his clients were not allowed to appear in court.

The three accused men – Amrozi Nurhasyim, his brother Ali Ghufron (alias Mukhlas), and Imam Samudra have been in court for years battling the terrorism charges. They are accused of staging the bombing in a nightclub in Bali in October of 2002, killing 88 Australians and 114 others. The penalty for their crimes is execution.

In what appears to be a stunt by their lawyer they are no longer making their appeal via a judicial review. Their lawyer has said he has no choice but to withdraw from the appeal case. It’s now expected that the lawyer will appeal directly to the president for clemency.

If this route is taken, and if by chance they do appeal for clemency and the president grants it. It will be interesting to see the response from Prime Minister Rudd in his first real foreign relations moment with Indonesia.

Should the alleged Bali bombers be granted clemency from the death penalty?
